<br />Resolution No. PC-95-96 <br />Page 2 <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Given the proposed location of loading activities and the existing <br />screening for the area proposed for outdoor storage, the use will not <br />negatively impact the surrounding uses. Other similar uses in the area <br />have been approved by the Planning Commission and have not caused any <br />reported problems. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />Chapter 18.124 of the Zoning Ordinance states that, because of their <br />unusual characteristics, conditional uses require special consideration so <br />that they may be located properly with respect to their effects on <br />surrounding properties. The recommended conditions of approval will <br />help to integrate the proposed use without detrimentally affecting the <br />surrounding properties of the City in general. As conditioned, the <br />proposed use will comply with all provisions and requirements of the <br />City's zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with the surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-95-74, the application of On-Top Construction for a <br />conditional use permit to operate a contractor's warehouse at 2126 Rheem Drive, <br />subject to the conditions shown in Exhibit "B," attached hereto and made part of <br />this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />It <br /> <br />II <br /> <br />.
