<br />Resolution No. PC-95-92 <br />Page 2 <br /> <br />Other retail and restaurant business located in the Mission Plaza shopping <br />center could potentially benefit from the presence of the Tae Kwon Do <br />studio in that they offer merchandise and/or services that would appeal to <br />the students, and/or parents of students, attending the martial arts studio. <br /> <br />2. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties <br />or improvements in the vicinity. <br /> <br />Existing wall construction between the martial arts studio and adjacent <br />tenants should provide adequate noise attenuation for the operations of this <br />studio. <br /> <br />Given the availability of parking at the Mission Plaza shopping center <br />property and the hours of operation of the martial arts studio's group <br />classes, the proposed Tae Kwon Do studio should not adversely affect the <br />availability of parking spaces in the shopping center complex. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The proposed conditional use is required to comply with all applicable <br />sections of the Pleasanton Municipal Code governing properties zoned <br />Central Commercial. By complying with the recommended conditions of <br />approval, the Tae Kwon Do studio would meet the criteria for receiving <br />a conditional use permit and would, therefore, comply with the intent of <br />the zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use, as <br />conditioned, is appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-95-72, the application of America's Best Karate, Inc. (Anthony <br />Chan) for a conditional use permit to allow the operation of a Tae Kwon Do studio in <br />an 1,800 square foot suite located in the Mission Plaza Shopping Center, 1991 Santa Rita <br />Road, Suite B, subject to the conditions shown on Exhibit "B" attached hereto and made <br />part of this case by reference. <br /> <br />II <br /> <br />. <br />
