CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 05-. <br /> <br /> RESOLUTION APPROVING THE JOINT USE AGREEMENT FOR THE <br /> VETERANS MEMORIAL BUILDING AT 301 MAIN STREET <br /> <br />WHEREAS, in 1932, Alameda County constructed the Pleasanton Veterans Memorial Building <br />on property at 301 Main Street that was originally deeded to the County by the Legion Memorial <br />Association, Pleasanton Post 237; and <br /> <br />WHEREAS, on April 3, 1973, the County of Alameda and the City of Pleasanton entered into <br />an agreement whereby the City was appointed as the County's agent to manage and operate the <br />Veterans Memorial Building at 301 Main Street, City of Pleasanton ("1973 Agreement"); and <br /> <br />WHEREAS, on February 1, 1994, pursuant to Resolution No. 94-12, the City Council <br />established a Veterans Memorial Building Advisory Commission to advise the Parks and <br />Community Services Department and/or City Council "on matters related to the maintenance, <br />upkeep, scheduling and use of the Veterans Building as it affects official Veteran Organization <br />use," with the Commission composed of a representative of the Veterans of Foreign Wars Post <br />6298, Veterans of Foreign Wars Post 9968, Veterans of Foreign Wars Auxiliary Post 6298 and <br />American Legion Post 237 and the City's Director of Parks and Community Services or <br />designee; and <br /> <br />WHEREAS, on January 7, 1997, pursuant to City Council Resolution No. 97-01, the City <br />agreed to accept the transfer of ownership of the Veterans Memorial Building and property from <br />the County thereby superseding the 1973 Agreement; and <br /> <br />WHEREAS, pursuant to Resolution No. 97-01, the City agreed that "all rights granted to <br />Veterans under the California Military and Veterans Code for the continued access to and <br />reasonable use of the Pleasanton Veterans Memorial Building shall be preserved"; and <br /> <br />WHEREAS, the City is contemplating a major renovation of the Pleasanton Veterans Memorial <br />Building to upgrade the facility in compliance with Federal, State and local requirements and to <br />provide amenities to serve better both the Veterans and the community at large; and <br /> <br />WHEREAS, the parties desire to memorialize in greater detail how the City and the Veterans <br />will jointly use the Veterans Memorial Building to augment but not rescind the City's prior <br />resolutions related to the Veterans Memorial Building; and <br /> <br /> <br />
