<br />.- <br /> <br />PLANNING COMMISSION CITY OF PLEASANT ON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-51 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF MICHAEL <br />AND LINDA KLIMENT FOR REZONING APPROVAL AS FILED UNDER CASE <br />RZ-95-03 <br /> <br />WHEREAS, Michael and Linda Kliment has applied to rezone an <br />approximately 1.153 acre parcel from the "Agricultural" <br />District and the "Planned unit Development - Low Density <br />Residential" District to R-1-40,000 (single-Family <br />Residential - Minimum 40,000 sq. ft. lot size) located at <br />5142 Foothill Road; and <br /> <br />WHEREAS, zoning for the property is Agricultural and PUD (Planned <br />unit Development) - Low Density Residential District; and <br /> <br />WHEREAS, at their duly noticed public hearing of August 9, 1995, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed <br />rezoning would bring the parcel into conformance with the <br />city's General Plan designation for the parcel, provide <br />one consistent zoning designation for the property, and <br />provide more appropriate development standards for the <br />property owner's use of the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Recommends approval of Case RZ-95-03, the application <br />of Michael and Linda Kliment to rezone an approximately <br />1.153 acre parcel from the "Agricultural" District and <br />the "Planned unit Development - Low Density Residential" <br />District to R-1-40,OOO (Single-Family Residential <br />Minimum 40,000 sq. ft. lot size) located at 5142 Foothill <br />Road. <br /> <br />Section 2. This resolution is effective immediately upon its <br />passage and adoption. <br />
