<br />. <br /> <br />Resolution No. PC-95-49 <br />Page 4 <br /> <br />EXHIBIT liB" <br />Conditions of Approval <br />Case UP-95-43 <br /> <br />1. The location and operation of the proposed take-out and delivery <br />only pizza restaurant shall conform substantially to the site <br />plan, floor plan, details of operation and related materials, <br />Exhibit A (dated "Received July 14, 1995"), on file with the <br />Planning Department, except as modified by these conditions. <br /> <br />2. <br /> <br />The applicant <br />ci ty permits <br />construction. <br /> <br />shall obtain all building and other applicable <br />for the project prior to the commencement of <br /> <br />3. The applicant shall obtain all necessary permits from the County <br />Department of Health Services prior to beginning the operation <br />of the restaurant. <br /> <br />4. If at any time in the future, the activities of the operation <br />deviate from the above-referenced description or the ownership <br />and/or management of the restaurant is unable to control the <br />activities such that the presence of the restaurant encourages <br />parking problems, circulation problems etc., to the detriment of <br />the surrounding uses or to the City in general, the Planning <br />Director may refer this use permit to the Planning Commission <br />for review at a public hearing. If necessary, the Planning <br />Commission may add conditions or revoke the subject conditional <br />use permit per Municipal Code Section 18.124.130. <br /> <br />5. All proposed signs for the restaurant shall conform with the <br />approved sign program for the center. Approval by the Planning <br />Department is required prior to installation of any signs. <br /> <br />6. The applicant shall maintain the area around the building in <br />which the proposed restaurant will be located in a clean and <br />orderly manner at all times. The applicant or property owner <br />shall provide a trash receptacle, subject to the review and <br />approval by the Planning Director, outside of the building <br />adj acent to the entrance. The management of the restaurant <br />shall also be responsible for the removal of Garlex food <br />containers that may be scattered in other areas of the center, <br />the adjacent driveway, and sidewalk area. <br /> <br />7. <br /> <br />Employee <br />adjacent <br />staff. <br /> <br />food delivery vehicles shall park in the stalls <br />to Valley Avenue until the parking plan is approved by <br /> <br />8. Delivery trucks shall use the area on the west side of the <br />tenant space. <br /> <br />{end} <br />
