<br />Resolution No. PC-95-49 <br />Page 2 <br /> <br />residential neighborhoods have been provided. <br />streets leading to the site are designed per City <br />standards and are signalized to provide safe access <br />into and out of the site. The conditions of <br />approval, as well as the applicant's design of the <br />tenant space, will ensure that the establishment <br />remains within the standards of all applicable City <br />codes. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The site's PUD-Commercial zoning permits the <br />establishment of take-out restaurants, as outlined <br />by Municipal Code section 18.44.090 "Permitted and <br />Conditional Uses in the C District." The proposed <br />restaurant complies with all relevant sections of <br />the zoning ordinance. Granting a use permit to <br />Garlex Pizza to operate a take-out and delivery <br />only restaurant is consistent with the City's <br />ability to regulate zoning as listed in Municipal <br />Code Section 18.124 "Conditional Uses." <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA); and <br /> <br />WHEREAS, the Planning commission determined that the proposed use, <br />as conditioned, would not have any adverse impact on the <br />circulation, parking, or maintenance of the facility, and <br />would be satisfactorily situated in the Valley Plaza <br />Shopping Center. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-95-43, the application of Gary Hamlin <br />(Garlex Pizza) for a conditional use permit to operate a <br />1,940 square foot take-out restaurant with delivery from <br />the Valley Plaza Shopping Center located at 4301 "A" <br />Valley Avenue, subject to the conditions shown on Exhibit <br />"B" attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. This resolution shall become effective 15 days after <br />its passage and adoption unless appealed prior to that <br />time. <br />
