The conditions of approval, as well as the applicant's design of the tenant space, will ensure that the establishment remains within the standards of all applicable City codes. C. The proposed conditional use will comply with each of the applicable provisions of this chapter. The site's PUD-Commercial zoning permits the establishment of take-out restaurants, as outlined by Municipal Code section 18.44.090 "Permitted and Conditional Uses in the C District." The proposed restaurant complies with all relevant sections of the zoning ordinance. Granting a use permit to Garlex Pizza to operate a take-out and delivery only restaurant is consistent with the City's ability to regulate zoning as listed in Municipal Code Section 18.124 "Conditional Uses." WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning commission determined that the proposed use, as conditioned, would not have any adverse impact on the circulation, parking, or maintenance of the facility, and would be satisfactorily situated in the Valley Plaza Shopping Center. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case UP-95-43, the application of Gary Hamlin (Garlex Pizza) for a conditional use permit to operate a 1,940 square foot take-out restaurant with delivery from the Valley Plaza Shopping Center located at 4301 "A" Valley Avenue, subject to the conditions shown on Exhibit "B" attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
