<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-47 <br /> <br />RESOLUTION DENYING CASE AP-95-06, THEREBY UPHOLDING THE DENIAL <br />OF THE APPLICATION OF KEN SEWELL, AS FILED UNDER CASE V-95-10 <br /> <br />WHEREAS, the Zoning Administrator denied Case V-95-10, the <br />application of Ken Sewell for a variance from the <br />Municipal Code to retain an existing carport which <br />encroaches within the required three (3) foot side yard <br />setback of the property located at 7254 South Valley <br />Trails Drive; and <br /> <br />WHEREAS, zoning for the property is R-1-6, 500 (Single-Family <br />Residential) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br />Code, the applicant filed an appeal with the City of <br />Pleasanton Planning Department; and <br /> <br />WHEREAS, at its duly noticed public hearing of July 26, 1995, the <br />Planning Commission considered all public testimony, <br />relevant exhibits, and recommendations of the City staff <br />concerning this application, and <br /> <br />WHEREAS, the Planning Commission determined that all three of the <br />required findings for a variance could not be made. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Denies Case AP-95-06, the appeal of the denial of the <br />Zoning Administrator of the application of Ken Sewell for <br />a variance from the Municipal Code to retain an existing <br />carport which encroaches within the required three (3) <br />foot side yard setback of the property located at 7254 <br />South Valley Trails Drive. <br /> <br />Section 2. This resolution shall become effective immediately upon <br />its passage and adoption. <br />
