<br />Resolution No. PC-95-44 <br />Page 3 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case PUD-90-01-3M <br /> <br />1. The modification to the PUD shall be substantially as shown <br />on the development plans, Exhibit "A", dated "Received <br />February 24, 1995 and April 26, 1995" on file with the <br />Planning Department, except as modified by the following <br />conditions. Minor changes to the plans may be allowed <br />subject to the approval of the Planning Director if found to <br />be in substantial conformance to the approved exhibits. <br /> <br />2. All conditions of Case PUD-90-01 and its subsequent <br />modifications PUD-90-01-1M, PUD-90-01-2M, and all conditions <br />of Vesting Tentative Map Tract 6282, shall remain in full <br />force and effect. <br /> <br />3. No other encroachments into side yard setbacks shall be <br />permitted. This modification to the PUD to allow porches <br />and porch eaves to encroach into the required five foot side <br />yard setback shall be applicable only to the five affected <br />lots (Lots 37, 59, 106, 107, 111: 3364 Hartwell Court, 3373 <br />Hadsell Court, 3662 Annis Circle, 3666 Annis Circle, and <br />3682 Annis Circle) and is for the sole purpose of addressing <br />an as-built condition. <br /> <br />4. The developer, Kaufman and Broad South Bay, shall file with <br />the City a recorded easement between 3364 Hartwell Court and <br />3376 Hartwell Court, allowing the property-owner at 3364 <br />Hartwell Court right of entry onto the property at 3376 <br />Hartwell Court for maintenance and access around the porch <br />and the side of the home, as necessary. Said easement shall <br />be recorded within 30 days of City Council approval of this <br />modification. <br /> <br />{end} <br />
