<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-95-44 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A MODIFICATION TO AN <br />APPROVED PLANNED UNIT DEVELOPMENT AS FILED UNDER CASE <br />PUD-90-01-3M (KAUFMAN AND BROAD SOUTH BAY, INC.) <br /> <br />WHEREAS, Kaufman and Broad South Bay, Inc. has applied for a <br />modification to an approved planned unit development to <br />modify the five-foot side yard setback requirement to <br />reflect the existing encroachments of the homes' <br />porches into the required five-foot side yard setback <br />for five homes located at 3364 Hartwell Court, 3373 <br />Hadsell Court, 3662 Annis Circle, 3666 Annis Circle, <br />and 3682 Annis Circle; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - MDR (Medium Density Residential) <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 28, 1995, <br />the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from <br />the requirements of the California Environmental <br />Quality ACT (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the <br />modification to the PUD is the most appropriate <br />response and resolution to this issue of an as-built, <br />non-conforming situation. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Recommends approval of Case PUD-90-01-3M, the <br />application of Kaufman and Broad South Bay, Inc., for a <br />modification to an approved planned unit development to <br />modify the five-foot side yard setback requirement to <br />reflect the existing encroachments of the homes' <br />porches into the required five foot side yard setback <br />for five homes located at 3364 Hartwell Court, 3373 <br />Hadsell Court, 3662 Annis Circle, 3666 Annis Circle, <br />and 3682 Annis Circle, subject to the conditions shown <br />on Exhibit liB," attached hereto and made part of this <br />case by reference. <br /> <br />Section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br /> <br />. <br />
