<br />i. The owner shall either not protest the establishment of an assessment <br />district, or shall affirmatively vote for the creation of the district or other <br />mechanism to pay the construction costs and all related construction costs, <br />including but not limited to engineering, City inspections, and financing, <br />for the 1-680/West Las Positas Boulevard freeway interchange, depending <br />on the manner of creation of the funding mechanism; <br /> <br />ii. The owner retains the right to protest that the allocation of costs among <br />various property owners is inequitable under the above-mentioned funding <br />mechanism; <br /> <br />Hi. In the event the assessment mechanism appears to impose economically <br />infeasible levels of costs upon the site, the City agrees to explore <br />alternative financing methods; notwithstanding, the City Council shall <br />retain the right to make the final determination of the appropriate <br />financing method; and <br /> <br />IV. The agreement shall be submitted to the City Attorney for review and <br />approval prior to recordation of the final parcel map and shall be <br />recorded with the parcel map to run with the land. <br /> <br />f. At no time shall balloons, banners, pennants, or other attention-getting devices <br />be utilized on the site except as allowed by Section 18.96.060 K. of the Zoning <br />Ordinance for grand openings or by Section 18.116.040 of the Zoning Ordinance <br />if approved by temporary conditional use permit as part of a decorating plan in <br />conjunction with shopping center promotional events. At no time shall spot <br />lighting be used after 10:00 p.m. in conjunction with such grand openings and/or <br />promotional events. <br /> <br />g. Final inspection by the Planning Department is required prior to occupancy. <br /> <br />h. The developer shall effectively screen from view all ducts, meters, air condition- <br />ing equipment, and any other mechanical equipment, whether on the structure, <br />on the ground, or on the roof, with materials architecturally compatible with the <br />main structure. Screening details shall be shown on the building plans submitted <br />for issuance of building permits for review and approval by the Planning Director <br />before issuance of building permits. The required screening shall be completely <br />installed prior to the structure's final inspection by the City. <br /> <br />i.
