The granting ora conditional use permit is not a right, but a discretionary action approved once <br />the City feels assured that potential detrimental effects of the use are controlled or mitigated. A <br />use permit carries with it the responsibility of minimizing negative impacts to surrounding <br />properties, residents and tenants. Staffbelieves the recommended conditions will achieve this <br />objective and will be appropriate to a new bar that may occupy the premises. In addition, as <br />previously mentioned, the use permit will be reviewed six months from the start of operations. <br />At that time, the appellants and/or their tenant may demonstrate to the Commission their proven <br />ability to act as a 'good neighbor' thereby possibly eliminating the need for one or more of the <br />conditions. <br /> <br />Pleasanton Downtown Association. The Pleasanton Downtown (PDA) supports the use permit <br />with the recommended modifications. <br /> <br />PUBLIC NOTICE <br /> <br />Staffmailed notices about the appeals to the amended conditional use permit and related public <br />hearing to property owners and tenants within 1,000 feet of the subject property. Prior to the <br />Planning Commission hearing, staff received several comments from the community regarding <br />this project. Staff incorporated the comments into the attached staff report. <br /> <br />ENVIRONMENTAL ASSESSMENT <br /> <br />Projects of this nature are categorically exempt fro the requirements of the California <br />Environmental Quality Act (CEQA). Therefore, no environmental document accompanies this <br />report. <br /> <br /> FISCAL IMPACT <br /> <br /> This project will have minimal fiscal impact on the City. <br /> <br /> CONCLUSION <br /> <br />Downtown Pleasanton is a vibrant city center that thrives on a diversity o£1and uses. Nighttime <br />eating and drinking establishments maintain the Downtown as a lively attraction and contribute <br />to the quality of the district so long as they operate in a manner that respects neighboring <br />properties, their owners and tenants. Staff believes that the use permit, as amended, will enable a <br />restaurant bar to he a benefit to the area while safeguarding neighboring properties from <br />mismanagement of operations. <br /> <br /> STAFF RECOMMENDATION <br /> <br /> Approve by taking the actions listed on pages 1-2 under "Staff Recommendation." <br /> <br />SR:05:093 Page 6 <br /> <br /> <br />
