PROJECT DESCRIPTION <br /> <br />The Planning Commission requested a public hearing to review the operations of the Union Jack <br />Pub for compliance with the conditions of approval of its use permit (UP-88-17). The use permit <br />allows operation of a restaurant/bar where alcohol can be served after 10:00 pm. As conditioned <br />by UP-88-17, the Planning Commission may conduct such review, and if necessary, apply <br />additional conditions to, or revoke, the subject conditional use permit. <br /> <br />PLANNING COMMISSION ACTION <br /> <br />The Planning Commission held a public hearing on February 23, 2005 to review the subject use <br />permit. The attached excerpts of the Planning Commission minutes provide detailed <br />information on this meeting. After hearing all public testimony, including residents and <br />Downtown business owners speaking for and against the use, the Commission approved on a <br />5-0 vote modifications to the use permit by adding a number of new conditions of approval. The <br />Commission added the following conditions: <br /> <br /> · Meals shall be served at all times that alcohol is served; <br /> <br /> · The hours of operation shall be reduced to 11:00 am to 11:00 pm Sunday through <br /> Thursday, 11:00 am to 12:00 midnight Friday and Saturday, and 11:00 am to 1:00 am on <br /> New Year's Eve; <br /> <br /> · The business owner and property owner shall engage security personal; <br /> <br /> · The owner shall install signs in the interior of the building on and/or near the exit doors <br /> stating that customers shall not loiter outside the establishment and shall be courteous and <br /> quiet when leaving the business and parking areas; <br /> <br /> · The business owner/property owner or designated representative of the business shall <br /> maintain the area surrounding the restaurant/bar, outdoor areas, adjacent walkways, parking <br /> lots, and public sidewalks in front of and 100 feet therefrom the north and south limits of <br /> the structure, in a clean and orderly manner at all times; <br /> <br /> · The outdoor patio shall be for dining only. No alcohol shall be consumed on the patio <br /> unless patrons are seated and eating a 'bona fide' meal served by waitstaff; <br /> <br /> · The doors of the restaurant/bar shall remain closed when not being used for ingress/egress <br /> purposes. The applicant shall install self-closing door mechanisms on all exterior doors; <br /> <br /> · The owner shall repair the existing adjacent wooden fence and install a 6 foot chain link <br /> fence adjacent to it to prevent patrons from cutting through to gain access to 725 Main <br /> Street. The owner shall maintain both fences in good repair. Any damage by patrons shall <br /> be repaired immediately; <br /> <br /> · The business shall comply with State law, as well as Pleasanton Municipal Code about <br /> smoking in public and work places; <br /> <br /> · The owner shall comply with all regulations associated with the license issued by ABC; and <br /> <br />SR:05:093 Page 3 <br /> <br /> <br />
