Ms. Decker requested additional clarification from the Commission and noted that Condition <br />No. 2 limits food service to 11:00 a.m. - 9:00 p.m. She understood that kitchen services should <br />be available whenever alcohol is served. <br /> <br />A discussion on smoking as it relates to State law ensued. <br /> <br />Chairperson Maas noted that them were currently no receptacles for cigarettes on the patio. <br /> <br />Ms. Nerland advised that State law generally applied to enclosed areas; the patio is not an <br />enclosed area. <br /> <br />Commissioner Ar[fin moved to make the findings to modify the use permit for UP-88-17 as <br />recommended in pages 1-3 of the staff report, with the following modifications: <br /> 1. Condition No. 2: Food shall be served at all times that alcohol is served; <br /> 2. Condition No. 10: The business shall comply with State law as well as Pleasanton <br /> Municipal Code about smoking in public and work places; <br /> 3.
