typo: the second listed Condition 9, addressing compliance with the ABC regulations, should be <br />listed as Condition I0. <br /> <br />Staff recommended that the Planning Commission discuss this issue, make the findings as <br />indicated on page 9 of the staff report, and adopt a resolution to either: <br />1. leave the conditions as they were stated per the 1988 use permit; <br />2. implement the recorrmaended conditions per staff's recommendations; <br />3. amend staff's recommended conditions; <br />4. suspend the use permit; or <br />5. revoke the use permit. <br /> <br />Ms. Decker stated that although it is not shown or reflected in the staff report, the Commission <br />may amend the use permit such that this establishment may be subject to one year for <br />performance measure. The owner may come back before the Commission for review <br />performance so that they may have the opportunity to perform under the conditions. <br /> <br />In response to an inquiry by Commissioner Roberts regarding the meaning of use permit <br />suspension, Ms. Nerland confirmed that the use permit may be suspended for a time period so <br />that any egregious activities may be mitigated, after which the business may re-open. The use <br />permit does not need to be suspended before it may be revoked. <br /> <br />In response to an inquiry by Chairperson Maas regarding the operational status of the business, <br />Ms. Decker confirmed that the business is currently closed for reasons other than the Planning <br />Commission's actions. <br /> <br />In response to an inquiry by Chairperson Maas regarding the hours of operation for the Crown <br />Pub, Ms. Decker confirmed that the closing times were midnight on weekdays, and 1:00 a.m. on <br />weekends. She added that the hours of operation for the Union Jack Pub were fashioned after <br />those of the Crown Pub, and then reduced. <br /> <br />In response to an inquiry by Commissioner Fox regarding a similar number of police calls for the <br />Popi Lounge and the crime management for that area of town, Lt. Darrin Davis, Pleasanton <br />Police Department, replied that Popi Lounge was slightly different because its use was strictly as <br />a bar. The Department had noticed a significant increase in the amount of criminal activity at <br />that location, mostly involving drinking, although there was a shooting at that location. The <br />Police Department had held meetings with the owners and management within the last month, <br />and steps have been taken to reduce the problem. He noted that the Union Jack Pub was a <br />restaurant/bar and that the police activity numbers were not comparable to a bar. <br /> <br />In response to an inquiry by Commissioner Fox whether the criminal activities would be <br />transferable elsewhere in the City if this use permit were to be revoked, Lt. Davis noted that <br />when one bar closed, others in the City were often impacted.
