WHEREAS, before the weeds are abated by the City or a contractor, any property owner may <br /> remove the weeds, rubbish or refuse at the property owner's own expense; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br /> AS FOLLOWS: <br /> <br />Section 1: The Fire Inspector is ordered to abate the nuisance declared by Resolution No. 05- <br /> 012 by causing the weeds, rubbish and refuse to be removed by the City or a <br /> contractor awarded the work by the City for the removal of weeds, rubbish or <br /> refuse, ,and for this purpose, the Fire Inspector (and/or the Fire Inspector's <br /> designee) and/or the contractor may enter upon private property to abate the <br /> nuisance. Before the weeds are abated by the City or a contractor, any property <br /> owner may remove the weeds, rubbish or refuse at the property owner's own <br /> expense. <br /> <br />Section 2: The Fire Inspector or the contractor, as the case may be, shall keep an account of <br /> the cost of abatement for each separate parcel of land where the work is done and <br /> shall submit to the City Council fur consideration, hearing and/or objections, <br /> modification and confirmation, an itemized written report showing the cost, all as <br /> more particularly described by Government Code Section 39574. <br /> <br /> Section3: The weed abatement costs, including a 100% mark up charge, shall be the <br /> responsibility of the property owner of the parcel of land where the work was <br /> done. <br /> <br />Section 4: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br /> REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br /> A MEETING HELD ON APRIL 5, 2005 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />ATTEST: <br /> <br /> Dawn Abrahamson, City Clerk <br /> <br /> APPROVED AS TO FORM: <br /> <br /> Michael H.
