All of the owners of properties included in Resolution No. 05-012 have been mailed a notice of <br />the order to abate the nuisance on their parcels and a notice of this protest hearing. For reference, <br />a copy of the property list included as Exhibit A to Resolution No. 05-012 is also included as <br />Exhibit A to the resolution attached to this staff report. In accordance with Government Code <br />section 39567.1, the notices were mailed to the property owner as provided in the last equalized <br />assessment roll available on March 01, 2005, the date of the adoption of Resolution No. 05-012 <br />Each notice was sent with an introductory letter, a list of weed abatement standards and a proof <br />of service. The proof of service was included to certify what documents were sent to the property <br />owners. <br /> <br />At this hearing, after considering any and all objections to the proposed abatement, the City <br />Council should overrule the objections to the proposed abatement and/or move to amend the list <br />of properties to be abated. The City Council should then adopt the attached resolution, as <br />amended (if at all), that orders a contractor to abate the weeds on the properties enumerated in <br />Resolution No. 05-012. <br /> <br />After this hearing, the Livermore-Pleasanton Fire Department inspectors will re-survey the <br />parcels listed in Resolution No. 05-012. If abatement has not occurred by May 31, 2005, a <br />contractor will abate the weeds. At a public hearing this summer, staff will recommend that the <br />City Council order that the abatement costs be a special assessment and lien imposed on the <br />properties requiring abatement. <br /> <br />FISCAL IMPACT <br /> <br />The weed abatement costs, including a 100% mark up charge, are recoverable and, at the <br />Council's motion, become a special assessment on the property owner's tax bill. All costs <br />involved with the Weed Abatement Program are budgeted under account # 122-181-4344. <br /> <br />STAFF RECOMMENDATION: <br /> <br />Staff recommends that the City Council adopt the attached resolution that orders the abatement of <br />weeds, rubbish and refuse on the properties enumerated in Resolution No. 05-012. <br /> <br />Stewat~Gar~ J Susan Rossi Nelson Fialho <br />Fire Chief ~ Director of Finance City Manager <br /> <br /> SR 05:088 <br /> Page 2 of 2 <br /> <br /> <br />
