<br />the approved PUD clearly limits where construction may occur on each lot. Mr. Raber <br />would like to construct his second unit outside of that envelope, which would be a <br />modification to the PUD. The Pleasanton Municipal Code has a defined process in Section <br />18.68.080 for those wishing to modify PUDs. The fact that the Deer Oaks development is <br />located on an environmentally sensitive hillside site complicates the review and mandates that <br />Mr. Raber provide all information necessary for the City to make a sound decision on his <br />proposal. Staff is treating Mr. Raber no differently than other applicants in similar situations <br />by asking that he follow the required course of action -- submittal of an application for a <br />PUD major modification and (eventually) an application for a use permit -- so that his project <br />may be evaluated properly. <br /> <br />IV.
