CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, ALAMEDA <br /> RESOLUTION NO. 05-008 <br /> <br /> RESOLUTION DENYING THE APPEAL (PAP-73) THEREBY <br /> UPHOLDING APPROVAL OF T~E APPLICATION OF MARI <br /> KENNARD AS FILED UNDER CASE PCUP-129 <br /> <br /> WHEREAS, on December 8, 2004, the Planning Commission approved the application <br /> of Mari Kennard for a conditional use permit to serve beer, wine, and <br /> spirits after 10:00 p.m. for The Oddfellows British Pub and Restaurant at <br /> 336 St. Mary Street; and <br /> <br /> WHEREAS, zoning for the property is Central Commercial (C-C), Downtown <br /> Revitalization, Core Area Overlay District; and <br /> <br /> WHEREAS, within the time specified by the Pleasanton Municipal Code, Karl and <br /> Brenda Sauter submitted an appeal to the City of Pleasanton; and <br /> <br /> WHEREAS, a duly noticed public hearing was held before the City Council on February <br /> 1, 2005, at which time all pertinent testimony and documents were <br /> reviewed; and <br /> <br /> WHEREAS, the City Council determined that the proposed use, as conditioned, is <br /> appropriate for the site. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> <br /> Section 1. Denies Case PAP-73, thereby approving Case PCUP-109, the application <br /> of Marl Kennard for a conditional use permit to serve beer, wine, and <br /> spirits after 10:00 p.m. for The Oddfellows British Pub and Restaurant at <br /> 336 St. Mary Street, subject to the conditions shown on "Exhibit B," <br /> attached hereto and made part of this case by reference. <br /> <br /> Section 2. The appellants shall be given notice of this action and informed that they <br /> have 90 days from the date of this resolution in which to file a court <br /> challenge. <br /> <br /> <br />
