<br />Exhibit B <br />Conditions of Approval <br /> <br />PCUP-127, Karen Marcum, Plush Beauty Bar <br />4001 Santa Rita Road <br />October 13, 2004 <br /> <br />1. The location and operation of the proposed use shall conform substantially to <br />Exhibit "A" (the site plan, floor plans, and details of operation), dated <br />"Received, September 29,2004," on file with the Planning Department, <br />except as modified by the following conditions of approval. Minor changes to <br />the approved operation and schedule may be approved by the Planning <br />Director if found to be in substantial compliance with the proposal. <br /> <br />2. If any changes are proposed to this conditional use permit from what was <br />stated in the applicant's statement of operation, dated "Received <br />September 29, 2004", on file in the Planning Department, prior City review <br />and approval is required. Such modification may be approved by the Planning <br />Director if found to be in substantial conformance with he approval. The <br />Planning Director may also refer the matter to the Planning Commission of <br />the proposed changes would be significant. <br /> <br />3. The applicant shall obtain all required permits from Alcoholic Beverage <br />Control agency prior to serving beer and wine inside the salon. No alcohol <br />may be served to minors, and all employees serving alcohol shall undergo <br />required training by the ABC. All wine sales and consumption shall be <br />conducted in a properly-designated and barricaded location in the facility. <br />The final design of the "bar area" shall be submitted for the review and <br />approval of the Planning Director prior to the commencement of alcohol sales <br />on the premises. <br /> <br />4. The applicant shall contact the Alameda County Health Department to obtain <br />any applicable licenses or inspection prior to any food being served on the <br />premises. <br /> <br />5. If operation of this use results in conflicts pertaining to noise, parking, <br />circulation, or other factors, at the discretion of the Planning Director, this <br />conditional use permit may be submitted to the Planning Commission for its <br />subsequent review at a public hearing. If necessary, the Planning Commission <br />may modify or add conditions of approval to mitigate such impacts or may <br />revoke the said conditional use permit approval. <br /> <br />I <br />
