<br />11. Only one residential unit on the subject property may be rented. The other unit shall be <br />owner-occupied. The resident owner shall be signatory to any lease for the second unit. <br />The second unit shall be occupied by no more than two adults and only the number of <br />children permitted by California state law. The project developer shall prepare a deed <br /> <br />restriction to this effect and shall submit it to the City Attorney for review and approval <br />prior to recordation. The deed restriction shall be recorded before issuance of an <br />occupancy permit for the second unit. <br /> <br />12. In no case shall the second unit be sold, subdivided, or held under different legal <br />ownership from the primary residence. The applicants shall prepare a deed restriction to <br />this effect and shall submit it to the City Attorney for review and approval prior to <br />recordation. The deed restriction shall be recorded before issuance of an occupancy <br />permit for the second unit. <br /> <br />13. One parking space shall be made continuously available to the occupant(s) ofthe second <br />unit for parking. In the event that the occupant(s) of the second unit own and operate <br />more than one auto, all vehicles shall be accommodated on-site. The project developer <br />shall prepare a deed restriction to this effect and shall submit it to the City Attorney for <br />review and approval prior to recordation. The deed restriction shall be recorded before <br />issuance of an occupancy permit for the second unit. <br /> <br />14. The project developer shall participate in a monitoring program for second units to <br />determine if they are being rented, and if so, their rent levels. <br /> <br />15. The project developer shall participate in City surveys on second unit occupancy and rent <br />characteristics. The purpose of these surveys is to help determine if second units are a <br />source of affordable housing for the community." <br /> <br />16. The project developer shall install address signs that are visible from the street, clearly <br />indicating that two separate units exist on the parcel. The project developer shall obtain <br />the new street address for the second unit from the Planning Department. <br /> <br />17. The height of the primary structure shall be surveyed and verified as being in <br />conformance to the approved building height as shown on Exhibit A or as otherwise <br />conditioned. Said verification is the project developer's responsibility, shall be performed <br />by a licensed land surveyor or civil engineer, and shall be completed and provided to the <br />Planning Department before the first framing or structural inspection by the Building <br />Department. <br /> <br />18. A list of the green building measures used in the design of the addition/remodeling of the <br />home covered by this approval shall be provided for the review and approval of the <br />Planning Director with the application for design review approval for the home(s).
