<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-58 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF F AIRLAND INVESTMENT, INC. <br />FOR DESIGN REVIEW APPROVAL, AS FILED UNDER CASE PDR-289 <br /> <br />WHEREAS, Fairland Investment, Inc. has applied for design review approval to construct a <br />self-service gasoline station on an approximately 1.25-acre site located at <br />3121 Bernal Avenue and 3581 Utah Street consisting of eight fuel dispensers, a <br />drive-through carwash, a 3,600-square-foot convenience market; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - Commercial) <br />District; and; and <br /> <br />WHEREAS, at its duly noticed public hearings of September 8, 2004 and September 22, 2004, <br />the Planning Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, at its meeting of September 22, 2004, the Planning Commission reviewed and <br />recommended approval of the Initial Study and Negative Declaration prepared for <br />this project, pursuant to Resolution No. PC-2004-56; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed project is in substantial <br />conformance with the Pleasanton General Plan and consistent with the appearance <br />of the existing residences in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Recommends approval of Case PDR-289, the application of Fairland Investment, <br />Inc. for design review approval construct a self-service gasoline station on an <br />approximately 1.25-acre site located at 3121 Bernal Avenue and 3581 Utah Street <br />consisting of eight fuel dispensers, a drive-through carwash, a 3,600-square-foot <br />convenience market, subject to the conditions shown in Exhibit "B," attached <br />hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective immediately upon its passage and <br />adoption. <br /> <br />1 <br /> <br />. <br />
