<br />EXHIBIT B <br />CONDITIONS OF APPROVAL <br /> <br />Case PSP-6/ PUD-96-4-1M, Berni Hatker <br />565 Sycamore Creek Way <br />August 25, 2004 <br /> <br />Planning <br /> <br />1. The Land Use Element (paragraph one) of the North Sycamore Specific Plan shall be <br />amended to include the following language: <br />"Development on portions of Parcel 11 desigoated as PUD-LDR shall be permitted that <br />meets the minimum established lot size shown for that area on Figure IV -1, but which <br />exceeds the maximum PUD-LDR density of2.0 dus/ ac. <br /> <br />2. The proposed development shall conform substantially to the development plan, dated <br />"Received June 3, 2004 and design guidelines/development standards Exhibit A, dated <br />"Received June 6, 2002", on file with the Planning Department, except as modified by these <br />conditions. Minor changes to the plans may be allowed subject to the approval of the <br />Planning Director if found to be in substantial conformance with the approved exhibits. <br /> <br />3. The maximum floor area ratio for the future homes, excluding up to 600 sq. ft. of garage <br />area, to be constructed on Lots 1 and 2 shall be limited to 25% of the respective lot areas. <br />The maximum house size on Lot 3 shall be no greater than 5000 sq. ft., excluding up to 600 <br />sq. ft. of garage area. The rear yard setbacks for the principal structures on all three lots shall <br />be a minimum of 25 ft. The minimum sideyard setback for principal structures on Lot 3 shall <br />be ten feet, with a minimum 25 feet total for both sideyard setbacks. <br /> <br />4. The proposed design guidelines shall be revised to include the following changes and shall be <br />submitted for review with the parcel map: <br />a) The floor area limits and rear yard setbacks shall be revised to match those in <br />COA#3. <br />b) Class I and II accessory structures shall be setback a minimum of 3 ft. from the <br />side property lines and 5 ft. from the rear property lines. <br />c) Unless otherwise specified in these conditions of approval and revised design <br />guidelines, development on all three lots shall be subject to the development <br />standards of the R-I-20,000 zoning district. <br /> <br />5. The development plan shall be of no further validity and the project developer shall be <br />required to submit the same or new development plan for City approval prior to development <br />of the site in the event that the project developer fails to record a final map within two (2) <br />years ofPUD approval. <br />
