<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-53 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />BERNI HAFKER FOR AN AMENDMENT TO The NORTH SYCAMORE SPECIFIC PLAN <br />AND FOR A MAJOR MODIFICATION TO AN APPROVED <br />PLANNED UNIT DEVELOPMENT DEVELOPMENT PLAN, <br />AS FILED UNDER CASE PSP-6/PUD-96-04-lM <br /> <br />WHEREAS, Berni Hafker has applied to amend the North Sycamore Specific Plan and for a <br />major modification to PUD-96-04 to allow the subdivision of an existing <br />1.29-acre property located at 565 Sycamore Creek Way into a three-lot custom <br />home development; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development - Low Density <br />Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of August 25, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning the Specific Plan amendment and the major modification; <br />and <br /> <br />WHEREAS, an Enviromnental Impact Report (ErR) was prepared and certified by the City <br />Council in February 1991, and the California Enviromnental Quality Act specifies <br />that individual residential development projects that are prepared pursuant to the <br />requirements of an adopted specific plan for which an EIR has been prepared and <br />certified are exempt from additional enviromnental review; and the proposed <br />specific plan amendment to add one lot on this property would be a minor change <br />in land use regulations, and, therefore, no environmental documentation <br />accompanies the proposed PUD development plan; and <br /> <br />WHEREAS, the Planning Commission determined that the Specific Plan amendment is <br />consistent with the City's General Plan and the North Sycamore Specific Plan; <br />and <br /> <br />WHEREAS, the Planning Commission determined that the proposed modification would be <br />consistent with other recently approved projects in the subdivision and would not <br />alter the natural topographical features of the area. <br /> <br />1 <br /> <br />.. <br /> <br />. <br />
