<br />EXHIBIT B <br />Conditions of Approval <br /> <br />P AP-69/PV -98/P ADR-932, Jean-Luc and Maureen Chatelain <br />4432 First Street <br />July 28, 2004 <br /> <br />1. The retention of the existing two-story accessory structure shall conform substantially to the <br />site plan, floor plan, and elevations, Exhibit "A-I," dated "Received June 17,2004," on file <br />with the Planning Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning Director if found <br />to be in substantial conformance with the approved exhibits. <br /> <br />2. All requirements of the Building and Fire Codes must be met in order for the existing <br />structure to be retained. Within sixty (60) days of the effective date of this approval, the <br />applicants shall submit complete construction drawings to the Building Department for <br />review and approval of the Chief Building Official and Fire Marshal. The applicant shall <br />start construction within ninety (90) days of issuance of a building permit and shall complete <br />the project within one (1) year of start of construction. The applicant shall comply with all <br />corrective actions required by the Chief Building Official and Fire Marshal within the time <br />period specified. No occupancy of the structure shall be permitted until such corrective <br />actions have been implemented to the satisfaction of the Chief Building Official. Failure to <br />comply with such corrective actions shall result in City enforcement proceedings. <br /> <br />3. Within seven (7) days of when this approval becomes effective, the applicant shall remove <br />construction materials, paint, etc. that have been stored in the side yard and rear yard setback <br />areas between the subject two-story accessory building and the common fence shared by <br />4420 First Street and 4443 Second Street. <br /> <br />4. Any modifications/revisions to the exterior of the building as a result of conforming to the <br />Building Code and Fire Code requirements requires review and approval by the Plarming <br />Director. The construction drawing submitted for plan check shall reflect all such changes. <br /> <br />5. The applicant shall propose in writing to the property owner at 4420 First Street to provide <br />landscaping along their common fence line, including the side yard between the accessory <br />structure and the fence within thirty (30) days of when this approval becomes effective. Such <br />landscaping may include trellises with vines which could screen views and soften the <br />northern building wall. If agreeable to the neighbor, the applicants shall submit a planting <br />plan for the review and approval of the Plarming Director prior to issuance of a building <br />permit. Such planting shall be installed at applicants' cost prior to final building inspection <br />and maintained by the applicants. <br /> <br />I <br /> <br />'" <br /> <br />. <br /> <br />. <br />
