PC-2004-48 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF JEAN-LUC AND MAUREEN <br />CHATELAIN FOR ADMINISTRATIVE DESIGN REVIEW AND VARIANCE APPROVALS, <br />AS FILED UNDER CASE PADR-932/PV-98 <br /> <br />WHEREAS, Jean-Luc and Maureen Chatelain have applied for administrative design review <br />and for variances from the Pleasanton Municipal Code to legalize an existing <br />two-story accessory structure with a second unit on the second floor located at <br />4432 First Street as follows: (l) allow the building to be located approximately <br />two feet, six inches from the side (northerly) property line and approximately one <br />foot, nine inches from the rear (easterly) property line, where a minimum <br />five-foot side yard setback and a minimum ten-foot rear yard setback, <br />respectively, are required for a detached second unit: (2) allow the building to be <br />approximately 25 feet in height where a maximum building height of 15 feet is <br />allowed for a detached accessory structure; (3) allow the northern sloping roof <br />plane to be approximately three feet from the side (northerly) property line where <br />a minimum of ten feet is required; and <br /> <br />WHEREAS, zoning for the property is RM-4,000 (Multiple-Family Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of July 28, 2004, the Plarming Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements ofthe <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the PI arming Commission made the following findings for the variance: <br /> <br />I. Because of special circumstances applicable to the property, including <br />size, shape, topography, location or surroundings, the strict application of <br />the provisions of this chapter deprives such property of privileges enjoyed <br />by other properties in the vicinity and under identical zoning <br />classification. <br /> <br />Setback Variances. The RM-4,000 zoning district requires a minimum lot width <br />of 70 feet, a minimum depth of 100 feet, and a minimum lot area of 8,000 square <br />feet. At 50 feet wide, the lot does not meet the minimum lot width requirement. <br />If the property met the minimum lot width of 70 feet or 20 feet wider than it <br />actually is, the variances for the side yard setback and sloping roof plane would <br />not have been necessary.
