<br />{Renumber Section 18.11 0.040.B, as necessary} <br /> <br />18.110.050 Locational Standards: <br /> <br />A. A personal wireless service facility shall be a permitted use in any zoning district only if <br />it complies with the locational standards stated in this Section and with all regulations <br />provided in this Chapter. <br />B. A personal wireless service facility shall not be located in any residential or <br />agricultural zoning district or in a planned unit development with a residential or <br />agricultural zoning designation unless all ofthe following criteria are met: <br />I. The residential zoning district, agricultural zoning district, or planned unit <br />development is developed, {[l has an approved development plan, or is aesignatea <br />as a fllislie Will iHstiMioHallaHs Hse in the General PIal!. <br />2. The area where the personal wireless service facility is proposed is designated as <br />permanent open space or is sesignates as a pll!Jlie aHa iHDtitationallaHs Hse iH the <br />General PlaH. <br />3. The personal wireless service facility is located a minimum of three hundred feet <br />(300') away from the property lines of all of the following: <br />a. Existing or approved residences in residential or agricultural zoning districts or in <br />plarmed unit developments with a residential or agricultural zoning designation; <br />b. Undeveloped residential or agricultural zoning districts or undeveloped plarmed <br />unit developments with a residential or agricultural zoning designation and without an <br />approved development plan. linless aesif:natea aD a Imblie aHa iHstitationallana Hse iH <br />the General PlaH; <br />c. A personal wireless service facility shall not be located within three hundred feet (300') <br />from the property lines ofthe uses listed in subsections B3a through B3e of this Section. <br />D. A personal wireless service facility shall not be located within the property lines of the <br />uses listed in subsections B3a through B3e of this Section. <br />E. A personal wireless service facility shall not be located in any district unless the proposed <br />facility is located as far away as is feasible from the property lines of the uses listed <br />above, in subsections B3a through B3e of this Section as determined by the Zoning <br />Administrator, or the facility meets the criteria provided in Section 18.110.060 of this <br />Chapter. An alternate alternative site or location shall be considered feasible if it is <br />located ftntrther away from the property lines listed in subsections B3a through B3e of <br />this Section than the proposed location, the same or a similar lease or purchase agreement <br />is available at this location as is available at the proposed location, and it is structurally <br />and technically feasible that this location can service the same or a similar coverage area <br />as proposed, while remaining in compliance with this Chapter. <br />I. Whether or not a personal wireless service facility can service the same or a <br />similar coverage area at an a1teffiate alternative location than proposed shall be <br />determined by an electrical engineer hired by the personal wireless service <br />provider and licensed by the State. <br /> <br />3 <br />
