<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-43 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF VINCENT & MURPHY, INC. <br />(UNITED GROWTH) FOR DESIGN REVIEW APPROVAL, <br />AS FILED UNDER CASE PDR-394 <br /> <br />WHEREAS, Vincent & Murphy, Inc. (United Growth) has applied for design review approval <br />to construct a 5,088-square-foot, one-story commercial building on the existing <br />building pad site near the McDonald's restaurant building located at 3001 Bernal <br />A venue at the southwest corner of Bernal A venue and Stanley Boulevard; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development -Commercial) <br />District. <br /> <br />WHEREAS, at its duly noticed public hearing of July 14,2004, the Plarming Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, an Initial StudyINegative Declaration was adopted by the City Council for <br />PDR-118, the McDonald's restaurant development, on August 21, 2001, in <br />conformance with the standards of the California Environmental Quality <br />Act (CEQA); and <br /> <br />WHEREAS, there are no substantial changes to the project or to the circumstances under which <br />the project is undertaken that involve new significant environmental effects or <br />substantially increase the severity of previously identified effects, and there is no <br />new information of substantial importance not known at the time the Initial <br />StudyINegative Declaration was adopted regrading the project or its effects, <br />mitigation measures, or alternatives; therefore, no additional environmental <br />documentation was prepared for this application; and <br /> <br />WHEREAS, the Plarming Commission determined that the proposed project is consistent with <br />the appearance of the existing buildings in the area. <br /> <br />., <br /> <br />- <br />
