<br />EXHIBIT B <br />CONDITIONS OF APPROVAL <br /> <br />PDR-357, Alexaodro Garcia, Blue Agave <br />625 Main Street <br />November 10, 2004 <br /> <br />Planning <br /> <br />I. Development shall be constructed substantially as shown on the development plans and <br />color/material board, Exhibit "A", dated "Received October 20,2004" on file with the <br />Planning Department, except as modified by the following conditions. Minor changes to <br />the plans may be allowed subject to the approval of the Planning Director if found to be <br />in substantial conformance to the approved exhibits. <br /> <br />2. The applicant shall obtain all building and other applicable City permits for the project <br />prior to the commencement of construction. <br /> <br />3. The applicant shall apply for and receive a sidewalk-dining permit from the Planning <br />Department prior to the addition of an outdoor dining area outside the fence and within <br />the city right-of-way. <br /> <br />4. Prior to the building permit stage, the plans shall be revised as follows: <br /> <br />a. All acorn-style lighting fixtures shall contain shields located inside the top of the <br />globes to minimize light pollution; <br />b. Sheet 2 and Sheet 3 shall be correlated to provide the same complementary small <br />light fixture locations and the intensity of proposed fence fixtures shall be reduced <br />by 25 percent; <br />C. Full details of the proposed handicap lift shall be incorporated into the plans; and <br />d. A landscape and irrigation plan shall be submitted for the review and approval by <br />the City Landscape Architect. Said landscape plan shall be detailed in terms of <br />species, location, size, quantities, and spacing. <br /> <br />5. The developer shall pay any and all fees to which the property may be subject prior to <br />issuance of building permits. The type and amount of the fees shall be those in effect at <br />the time the building permit is issued. <br /> <br />6. This design review approval shall lapse and shall become void one year from the date of <br />approval unless a building permit is issued and construction has commenced and is <br />diligently pursued toward completion or an extension has been approved by the City. <br /> <br />1 <br />
