<br />EXHIBIT B <br />CONDITIONS OF APPROVAL <br /> <br />PCUP-112, Achievement Learning Center <br />231 Old Bernal Avenue, Suite 1 <br />June 9, 2004 <br /> <br />I. The location and operation of the proposed use shall conform substantially to Exhibit <br />"A" (the site plan, floor plans, and details of operation), dated "Received, April 19, <br />2004," on file with the Plarming Department, except as modified by the following <br />conditions of approval. Minor changes to the approved operation and schedule may <br />be approved by the Plarming Director if found to be in substantial compliance with <br />the proposal. <br /> <br />2. The operation of the tutoring center shall generally adhere to the following schedule: <br /> <br />Monday through Friday: <br /> <br />Saturday: <br /> <br />3:00 p.m. to 7:30 p.m. (school months) <br />2:00 p.m. to 6:30 p.m. (non-school months) <br />By Appointment <br /> <br />Summer Camp: <br /> <br />Monday through Friday, morning only <br /> <br />3. If additional hours and activities beyond what was stated in the applicant's statement <br />of operation, dated "Received April 19, 2004", on file in the Plarming Department, <br />are desired, prior City review and approval is required. Such modification may be <br />approved by the Plarming Director if found to be in substantial conformance with he <br />approval. The Plarming Director may also refer the matter to the Plarming <br />Commission of the proposed changes would be significant. <br /> <br />4. The size of the tutoring center shall be three instructors and five students receiving <br />academic instructions. The applicant may add additional number ofinstructor(s) and <br />student(s) upon the approval by the Plarming Director if sufficient parking exists on <br />the subject site. <br /> <br />5. At no time shall summer camp and regular tutoring sessions be held simultaneously. <br /> <br />6. If operations of this use permit results in conflicts pertaining to parking, interior <br />and/or exterior noise, traffic/circulation, or other factors, at the discretion of the <br />Plarming Director, this conditional use permit may be submitted to the Planning <br />Commission for their subsequent review at a public hearing. If necessary, the <br />Plarming Commission may modify or add conditions of approval to mitigate such <br />impacts, or may revoke the said conditional use permit approval. <br /> <br />1 <br />
