The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Based on its operation in the past years, the subject after-school learning center <br />would be compatible with other uses in the same zoning district. The majority of <br />the students would be dropped off and picked up by their parents. Thus, it is not <br />likely that students would congregate either in the hallway or in the parking lot <br />before and after the tutoring sessions. The learning center is a quiet use as <br />instruction would be held at low-volume voice level. Thus, nearby residential <br />properties and businesses should not be disturbed by the tutoring business. <br />Additionally, adequate and safe ingress and egress into and out of the site and <br />sufficient on-site parking would make the proposed use suitable for the subject <br />site. Therefore, this finding can be made. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br /> <br />The site's Office zoning conditionally permits the establishment of tutoring <br />facilities. The learning center complies with all relevant sections of the zoning <br />ordinance. Therefore, this finding can be made. <br /> <br />WHEREAS, the Plarming Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-112, the application of Mary Kay Berg!Achievement <br />Learning Center for conditional use permit to operate a private tutorial school in <br />the existing building located at 231 Old Bernal Avenue, Suite 1, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
