<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-13 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF VALLEY HUMANE SOCIETY FOR <br />DESIGN REVIEW, CONDITIONAL USE PERMIT, AND VARIANCE APPROVALS <br />AS FILED UNDER CASE PDR-290/PCUP-87/PV-89 <br /> <br />WHEREAS, Valley Humane Society has applied for design review and conditional use permit <br />approvals to construct a new, approximately 5,240-square-foot one-story building <br />and for a variance from the Municipal Code to allow a building setback of five <br />feet for a 30-foot long portion of the proposed building, where ten feet is required, <br />for property located at 3670 Nevada Street; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - Commercial) <br />District; and <br /> <br />, <br /> <br />WHEREAS, at its duly noticed public hearing of February 11,2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings for the conditional use <br />permit: <br /> <br />1. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The site of the proposed use is located in the Stanley Business Park, zoned <br />PUD-C, which conditionally permits veterinary clinics with overnight boarding. <br />The Valley Humane Society provides an animal adoption service for dogs and <br />cats only, overnight boarding and care for its animals awaiting adoption, and <br />educational services that would be available to the community that would be very <br />compatible with the surrounding businesses and tenants in the business park. The <br />activities of the Humane Society are sufficiently similar to the activities of a <br />veterinary clinic that it can be considered consistent with this use classification for <br />the business park. The conditions of approval proposed for this project give the <br />City the appropriate controls to ensure that the use does not have any negative <br />impacts on the surrounding businesses. Thus, the use permit for the Valley <br />Humane Society is in accordance with the objectives of the zoning for this <br />district. Therefore, this finding can be made. <br />
