<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-2004-12 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF UWE W AIZENEGGER/HACIENDA <br />MOTORS FOR CONDITIONAL USE PERMIT AND DESIGN REVIEW APPROVALS, <br />AS FILED UNDER CASE PCUP-I06/PDR-349 <br /> <br />WHEREAS, Uwe Waizenegger/Hacienda Motors has applied for conditional use permit and <br />design review approvals to operate a pre-owned automobile sales business that <br />includes a showroom, a quick-serve department, and outdoor vehicle display for <br />property located at 5871 Owens Drive; and <br /> <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development - Industrial/ <br />Commercial-Office) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of February II, 2004, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />1. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Objectives of the zoning ordinance include fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from <br />inharmonious influences and harmful intrusions; and insuring that public and <br />private lands ultimately are used for the purposes which are most appropriate and <br />beneficial to the City as a whole. The proposed pre-owned automobiles sales <br />business is a division of the existing dealership that has been in business for over <br />a decade. During the past years, the dealership has been managed professionally, <br />and there have been no complaints regarding the business. If managed in the <br />same manner as it currently is, the proposed pre-owned vehicle sales and service <br />business would be consistent with the above-cited objectives. Furthermore, the <br />business is located in a commercial area with good freeway access and would be <br />compatible with the surrounding uses. The expansion of the automobile <br />dealership would also promote the economic vitality of the area and the <br />community. Therefore, this finding can be made. <br />
