<br />Exhibit B <br />Conditions of Approval <br /> <br />PCUP-I05, Dermalogica, Inc. <br />6678 Owens Drive <br />January 28, 2004 <br /> <br />I. The proposed use covered by this approval shall be in substantial conformance to the plans and <br />narrative, shown as Exhibit A, dated "Received September 9,2003," on file with the Planning <br />Department, except as modified by the following conditions. Minor alterations may be approved <br />by the Planning Director if found to be in substantial conformance with this approval. <br /> <br />2. Approval ofthis application shall be contingent upon approval of the PUD minor modification <br />application (Case No. PUD-80-14-07M). <br /> <br />3. The operation of the business school shall generally adhere to the following schedule: <br />Monday through Friday: from 10:00 a.m. to 5:00 p.m. <br />Maximum of students: 16 <br /> <br />4. In the event that the applicants propose to modify the hours of operation or other aspects of the <br />business operation, or modify the exterior building or site, the modification shall be subject to <br />the review of the Planning Director. The Planning Director may approve the modification or <br />refer the matter to the Planning Commission if judged to be substantial. <br /> <br />5. If operations of this use permit results in conflicts pertaining to parking, interior noise, <br />traffic/circulation, or other factors, at the discretion of the Planning Director, this conditional use <br />permit may be submitted to the Planning Commission for their subsequent review at a public <br />hearing. If necessary, the Planning Commission may modify or add conditions of approval to <br />mitigate such impacts, or may revoke the said conditional use permit approval. <br /> <br />6. Only one class/training session shall be held at one time. <br /> <br />7. The applicant shall continue to encourage its clients to use charter buses and carpools to attend <br />the monthly "open student day" event. <br /> <br />8. The "open student day" event shall be held after 5:00 p.m. on a regular business day, or on <br />weekends if complaints concerning parking are reported to the Planning Department. At that <br />time, staffwill notify the applicant in writing. Within thirty (30) days upon receipt of the City <br />written notification, the applicant provide a copy of the class schedule to the Planning <br />Department indicating that the monthly "open student day" event will be held either as an after- <br />hour event or on weekend. The first evening or weekend "open student day" event shall be held <br />within sixty (60) days from the date ofthe City written notice. <br /> <br />{end} <br />
