<br />Exhibit D <br /> <br />Proposed Amendment to the Downtown Specific Plan <br />PSP-5, Valley Park Associates, LLC <br />325 Ray Street <br />January I4, 2004 <br /> <br />The existing language of Section 3 under Commercial Use of the Land Use Policies and <br />Programs of the Downtown Specific Plan: <br /> <br />3. Future development at 325 Ray Street shall be designed as a garden office <br />complex with a one-story maximum building height, residential architectural <br />style, and preservation of the area nearest the Arroyo del Valle. Public pedestrian <br />access through the property to the Arroyo is strongly encouraged. Future <br />development of this site should be carefully designed to mitigate the potential <br />impacts on adjacent properties. <br /> <br />Shall be amended to read as follows: <br /> <br />3. Future development at 325 Ray Street shall be designed as a garden office <br />complex with a residential architectural style and preservation of the area nearest <br />the Arroyo del Valle. The building shall generally be limited to a one-story <br />building height, except that a small (maximum 20 percent of the total building <br />floor area) two-story building element may be allowed, provided it is <br />well-integrated into the building design, is located at the westerly side of the site, <br />and does not have windows which directly face the Walnut Drive properties. <br />Public pedestrian access through the property to the Arroyo is strongly <br />encouraged. <br /> <br />{end} <br /> <br />I I <br />
