<br />Exhibit B <br />Conditions of Approval <br /> <br />PUD-85-5-7D-2M, Kobl's Department Store <br />4525 Rosewood Drive <br />January 14,2004 <br /> <br />I. Development shall be substantially as shown on the development plans, colorboard, and LEED <br />checklist and worksheets, Exhibit "A," dated "Received January 6, 2004" on file with the <br />Planning Department, except as modified by the following conditions. Minor changes to the <br />plans may be allowed subject to the approval of the Planning Director if found to be in <br />substantial conformance to the approved exhibits. <br /> <br />2. All conditions ofPUD-S5-S-7D and PUD-S5-S-7D-IM shall remain in full force and effect, <br />unless superseded by the conditions of this application. <br /> <br />3. All proposed signage shall comply with the requirements of the previously-approved Metro 5S0 <br />shopping center sign program. The signage proposed on the side of the store shall be reduced to <br />the maximum three ft. height allowed by the sign program. Details of the proposed signs shall <br />be submitted for the review and approval of the Planning Director prior to installation. <br /> <br />4. The developer shall revise the proposed improvement plans for the new Rosewood Drive <br />entrance into the shopping center and related median modifications to the satisfaction of the City <br />Traffic Engineer and Planning Director. All feasible measures shall be taken to minimize the <br />removal oflandscaped median from this section of the roadway. The developer shall be <br />responsible for the cost to design and install the necessary improvements needed for this new <br />shopping center entrance. The developer shall provide for safer pedestrian crossing in front of <br />the store in the east end of Building 2 by installing planters or benches by the entrance to the <br />building to preclude people from walking directly out into the drive aisle at this point and by <br />installing a textured paving at the adjacent crosswalk. The installation of speedbumps may be <br />considered. <br /> <br />5. The project developer shall pay any and all fees to which the property may be subject prior to <br />issuance of building permits. The type and amount of the fees shall be those in effect at the time <br />the building permit is issued. <br /> <br />6. This design review approval will lapse within one (I) year from the date of approval unless a <br />building permit is issued and construction has commenced and is diligently pursued toward <br />completion or an extension has been approved by the City. <br /> <br />7. All conditions of approval for this case shall be written bv the proiect developer on all <br />buildinl! permit plan check sets submitted for review and approval. These conditions of <br />approval shall be on, at all times, all grading and construction plans kept on the project site. It is <br />the responsibility of the building developer to ensure that the project contractor is aware of, and <br />abides by, all conditions of approval.
