The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Given the large number of parking spaces for the office building, and given the <br />number of parking spaces available during the projected busy hours for the <br />subject use, the proposed self-defense studio would have adequate off-street <br />parking to meet the demand and would not adversely impact the adjacent tenants. <br />The proposed use is to be operated entirely indoors, and its classes should not <br />interfere with adjacent uses. The streets leading to the site are designed per City <br />standards and are signalized to provide safe access into and out of the site. A <br />condition of approval has been added which limits parking to designated areas <br />during early morning hours to mitigate impacts due to parking cars on nearby <br />residences. Any areas of possible concerns have been conditioned so that the <br />proposed use would be operated in a non-nuisance manner. Furthermore, the <br />applicant can be required to mitigate any future nuisances of problems. <br />Therefore, this second finding can be made. <br /> <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of the Zoning Ordinance. <br /> <br />The site's zoning regulations conditionally permit the establishment of private <br />schools, including self-defense studios. The proposed use complies with all <br />relevant sections of the zoning ordinance. Granting a conditional use permit to <br />the applicant for a personal training facility would be consistent with the City's <br />ability to regulate zoning as listed in the Municipal Code. Therefore, the third <br />finding can be made. <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-I 02, the application of David Moeller for a conditional use <br />permit to operate a self-defense facility within an existing building located at <br />5724 West Las Positas Boulevard, subject to the conditions shown in Exhibit "B," <br />attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
