- Mari Kennard, applicant, 4959 Blackbird Way, explained the vision of her restaurant in a <br />heritage building and hoped for it to become a Pleasanton landmark. She noted that it <br />would engender the same feeling as in the Danville location and added that more than <br />60 percent of its revenue came From food. She stated that most of the alcohol consumed <br />was by people dining and emphasized that was the core business. She noted that <br />contemporary and classic rock was preferred and that the volume would be kept at an <br />appropriate level. She added that hip-hop or techno music would not be played in order <br />to attract a slightly older crowd. She noted that she carefully monitored the live bands' <br />volume during their performances and added that it was very important for the business <br />to be considerate of the surrounding neighborhood and to ensure that its patrons were <br />kept under control as well, particularly in the outdoor dining areas. She would be able to <br />bring outdoor diners inside after the outdoor closing time. <br />In response to an inquiry by Commissioner Arkin about the operator's previous proposal <br />to locate the business at 780 Main Street, Ms. Kennard advised that she was unable to <br />come to an agreement with the owner. <br />In response to an inquiry by Commissioner Blank regarding diners under the age of 21, <br />Ms. Kennard replied that they are very careful about LD. She noted that minors normally <br />dined with their parents or in a family group, which was a common occurrence. <br />Roy Moret, 739 Main Street1129 Sand Wedge, Walnut Creek, advised that he owned and <br />managed the Los Pilares building at 739 Main Street and supported the proposed project. <br />He strongly urged continued monitoring of the conditions if approved. He believed the <br />conditions would serve the good of the community and believed the use would be <br />beneficial to Downtown Pleasanton. He read a letter into the record from a former <br />tenant, whom he lost in August after 11 years: <br />"Dear Roy, <br />After much consideration, weighing all pros and cons, we have made the <br />painful decision not to renew our lease here at 739 Main Street when it expires on <br />July 31. It was not an easy decision to make, nor is this an easy letter to write. <br />The pub next door continues to be the one and only reason for our need to relocate <br />our offices. The conditions in the rear of the pub and in the parking lot remain <br />unacceptable. We do appreciate what you have done for us in this unfortunate <br />situation, and we have enjoyed our tenancy here. Thank you for all that you have <br />done for us." <br />Mr. Moret noted that his tenants had experienced numerous incidences of vandalism and <br />harassment resulting from their proximity to the Union Jack Pub. He urged the <br />Commission to require an additional review upon each change of management or <br />ownership. <br />In response to an inquiry by Chairperson Roberts about the age range of patrons at the <br />Union Jack, Mr. Moret replied that one patron who caused a disturbance was in his <br />- late 30's. <br />PLANNING COMMISSION MINUTES, December 8, 2004 Page 10 of 19 <br />
