Resolution No. PC-2004-56 was entered and adopted as motioned. <br />Chairperson Roberts advised that the next item was to make the finding whether the <br />project conformed to Pleasanton's General Plan. <br />Commissioner Maas expressed concern about the sale of alcohol and the close proximity <br />of Shadow Cliffs Regional Recreation Area. <br />Commissioner Fox agreed with Commissioner Maas's concern. <br />Chairperson Roberts advised that Shadow Cliffs did not allow alcohol and that Express <br />Liquors was located approximately three blocks from McDonald's. She advised that both <br />Albertson's and Safeway also sold alcohol. <br />Commissioner Maas noted that while she believed that people were responsible for <br />themselves, alcohol sales should not be too conveniently close to Shadow Cliffs. <br />Commissioner Arkin noted that the sale of alcohol at this store was not an issue for him <br />and that 24/7 operating hours were appropriate. <br />Commissioner Fox expressed concern about people buying alcohol and loitering in the <br />McDonald's parking lot. She was also concerned about the sale of alcohol so close to the <br />synagogue and the preschool. <br />In response to an inquiry by Chairperson Roberts whether she had contacted the Rabbi, <br />Commissioner Fox replied that she had called but was not able to speak to him. She <br />ensured that they received a staff report; they had not received a notice for this <br />application. <br />Ms. Kline advised that the applicant had met with the Rabbi. <br />Commissioner Fox moved to prohibit beer and wine sales as part of the Conditional <br />Use Permit. <br />There was no second. <br />The motion failed for lack of a second. <br />Commissioner Roberts moved to allow the Conditional Use Permit to sell beer and <br />wine at this location. <br />Commissioner Arkin seconded the motion. <br />PLANNING COMMISSION MINUTES, September 22, 2004 Page 7 of 14 <br />
