_ and the Planning Commission regarding closing off the property but that he was informed <br />that a fence would prevent a free flow of neighbors and would not be compatible with the <br />overall guidelines of the Bernal Property project to create a walkable community. He <br />added that he was now ready to build adouble-sided redwood fence as this was the right <br />thing to do for the neighborhood. He noted that the carwash was necessary for the <br />financial viability of the project. <br />Mr. Theobald then presented the mitigations that have been done to address several <br />neighborhood issues: the modification of the gooseneck lighting fixtures with shields and <br />frosted bulbs and the installation of a timer to turn them off at midnight; the addition of <br />130 plantings to enhance the site and address the monument area; the modification of the <br />grease truck pick-up hours from 4:30 a.m. to early afternoon; the transfer of the employee <br />smoking area from behind the trash dump to the side of the carwash building; the policy <br />of no trash dumping after dark and the modified trash pick-up hours by Pleasanton <br />Garbage Service; the modification of the steel fencing on the east side of the property to <br />prevent the penetration of light from the drive-through lane; and the grading of City <br />property on the south side to alleviate any standing water. <br />Mr. Theobald then discussed the noise issue stemming from the carwash and the <br />Jack-in-the-Box speaker. He stated that they were assured before they purchased the <br />carwash system that 60 dBA would not be a problem and that they had done noise <br />readings at that time with results lower than the acceptable 60 dBA. He pointed out that <br />they had installed mufflers in the carwash but that it has not been in operation for the past <br />~` week at the request of City staff. He added that he was working with Jack-in-the-Box <br />regarding the drive-through speaker. He indicated that the noise issue could be corrected <br />with changes and improvements to the equipment and that the construction of the fence <br />would minimize future impacts. <br />Finally, Mr. Theobald noted that other issues brought up were not related to the business, <br />such as general problems with traffic in area; circulation and parking; and the lack of <br />disclosure by KB Homes. He emphasized that contrary to claims, no alcohol was sold in <br />the premises and that they were responsible individuals who would not jeopardize the <br />operation, their families, and themselves by selling alcohol without a permit. He <br />concluded that they had collected signatures from approximately 400 Pleasanton <br />customers showing appreciation for the existence of the service station in the area. <br />Mr. Theobald then reiterated that the carwash is an economic necessity and requested that <br />it be allowed to operate on a limited basis, from 9:00 a.m. to 8:00 p.m., until such time as <br />the fence is put up. <br />Discussion ensued regarding whether disclosures were made in connection with the <br />drive-through and the carwash when the KB Homes were sold. Mr. Theobald read the <br />disclosure statement provided by KB Homes to its buyers. Commissioner Sullivan <br />commented that he recalled the houses were built before the service station was <br />approved; the Commission then asked staff about the timeline involving both projects. <br />PLANNING COMMISSION MINUTES July 28, 2004 Page 5 of 19 <br />
