THE PUBLIC HEARING WAS OPENED. <br />Gary Drew, project architect, 5000 Executive Parkway, Suite 298, San Ramon, advised <br />that he would be available to answer any questions. <br />In response to an inquiry by Commissioner Sullivan, Mr. Drew advised that between <br />20 and 30 vehicles were generally moved by 9:30 a.m. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Maas moved to make the use permit findings and approve <br />PCUP-106/PDR-349 as conditioned in the staff report and subject to the conditions <br />listed in Exhibit B, including the modification of Condition 6 on the staff <br />memorandum. <br />Commissioner Kameny seconded the motion. <br />In response to an inquiry by Commissioner Sullivan, Mr. Iserson confirmed that if there <br />were any safety or congestion problems with the transfer of cars, the complaint would be <br />referred to the Planning Commission. <br />ROLL CALL VOTE <br />AYES: Commissioners Kameny, Maas, Roberts, and Sullivan. <br />NOES: Commissioner Fox. <br />ABSTAIN: None. <br />ABSENT: Commissioner Arkin. <br />Resolution No. PC-2004-12 was entered and adopted as motioned. <br />b. PDR-290/PV-89/PCUP-87, Valley Humane Society <br />Applications for design review and conditional use permit approvals to construct <br />a new, approximately 5,240-square-foot one-story building and for a variance <br />from the Municipal Code to allow a building setback of five feet fora 30-foot <br />long portion of the proposed building, where ten feet is required, for property <br />located at 3670 Nevada Street. Zoning for the property is PUD-C (Planned Unit <br />Development -Commercial) District. <br />Mr. Iserson summazized the staff report and noted that the Humane Society had outgrown <br />its current quarters. He described the project site and the proposed use. Staff believed <br />the use would be compatible with the existing uses in Stanley Business Park, especially <br />the automotive repair and other service uses, as well as with the residential uses on the <br />other side of the arroyo. <br />Mr. Iserson advised that staff had been contacted by two neighbors, whose concerns <br />about noise, screening, lighting and odor had been addressed.
