precedent was being set to shoehorn other buildings into the arroyo front that may not be <br />suitable. He had envisioned open space and some public access between the road and the <br />arroyo. <br />Commissioner Maas complimented the applicant's team on their presentation and noted <br />that their current facility was very small. She noted that the fire station had been built by <br />the arroyo and compared the VHS' application to that situation. She noted the location <br />was convenient to other services such as McDonald's. <br />Commissioner Fox requested that staff take special attention in addressing the drainage <br />by the back patio and suggested putting a gutter or decomposed granite around the patio. <br />Commissioner Maas moved to make the use permit and variance findings and <br />approve PDR-290/PV-89/PCUP-87 as conditioned in the staff report and subject to <br />the conditions listed in Exhibit B, and with the following modifications: <br />1. Modify Condition No. 57 (Exhibit C) to read as follows: "The project <br />developer shall dedicate the necessary right-of--way and shall participate in a <br />deferred improvement agreement with such surety as acceptable to the City <br />Attorney and the City Engineer to widen and improve Nevada Street between <br />the two driveways." <br />2. Delete Condition No. 4 (Exhibit B) to remove the time limitation for public <br />education. <br />3. Modify Condition No. 5 (Exhibit B) to read as follows: "Veterinary services <br />shall be provided only to the animals being cared for by the Valley Humane <br />Society for adopting, not to the public, °°a °°'°'~°r°°°~..r.,._ ,....._..«:..,. <br />heur~." <br />4. Add a new condition to include a special drainage system for the back patio. <br />Chairperson Roberts seconded the motion. <br />ROLL CALL VOTE <br />AYES: Commissioners Arkin, Kameny, Maas, and Roberts. <br />NOES: Commissioner Sullivan. <br />ABSTAIN: None. <br />ABSENT: None. <br />Resolution No. PC-2004-13 was entered and adopted as motioned. <br />The Planning Commission recessed for a break at 9:23 p.m. <br />Chairperson Roberts reconvened the meeting at 9:33 p.m. <br />PLANNING COMMISSION MINUTES February 11, 2004 Page 10 of 19 <br />
