6. PUBLIC HEARINGS AND OTHER MATTERS <br />a. PUD-80-14-07M/PCUP-105, Dermaloeica, Inc. <br />Applications for a minor modification to an approved PUD development plan <br />(PUD-80-14, Pleasanton Park) to conditionally permit private schools and for conditional <br />use permit approval to operate atrade/business school in an existing building located at <br />6678 Owens Drive. Zoning for the property is PUD-C (Planned Unit Development - <br />Commercial) District. <br />Mr. Iserson summazized the staff report. He noted that minor PUD modifications are not <br />normally acted upon by the Planning Commission, but because it was presented as part of the <br />application, staff wanted to give the Commission an opportunity to comment on it. He described <br />the use and its history and noted that the applicant had not been aware that a conditional use <br />permit was required. Staff was not aware until recently that the school was in operation and, <br />therefore, needed a use permit. Because a trade school use was not specifically listed in the PUD <br />as an allowed use, the applicant applied for a minor modification to the PUD. <br />Staff noted that there was sufficient parking on the site as conditioned and added that there <br />would be no impacts on adjacent uses. Staff recommended approval of this item. <br />In response to an inquiry by Commissioner Arkin, Mr. Iserson confirmed that the minor PUD <br />modification would be placed on City Cowicil's Consent Calendar. A condition of approval <br />stated that the use permit would not take effect unless the minor modification was approved. <br />In response to an inquiry by Chairperson Roberts, Mr. Iserson stated that other businesses in the <br />park were polled, but they were not interested in joining the PUD modification. <br />THE PUBLIC HEARING WAS OPENED. <br />The applicant was not in attendance. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Maas moved to support the proposed minor modification, PUD-80-14-07M, <br />and to make the use permit findings and approve PCUP-105 as conditioned in the staff <br />report and subject to the conditions listed in Exhibit B. <br />Commissioner Arkin seconded the motion. <br />ROLL CALL VOTE <br />AYES: Commissioners Arkin, Fox, Maas, Roberts, and Sullivan. <br />NOES: None. <br />ABSTAIN: None. <br />ABSENT: Commissioner Kameny. <br />Resolution No. PC-2004-08 was entered and adopted as motioned. <br />PLANNING COMMISSION MINUTES January 28, 2004 Page 3 of 17 <br />
