the fence design standards of the Specific Plan. In fact, the Bozorgzad PUD development plan <br />shows a solid, six-foot tall fence adjoining the sidewalk. Because the wall/fence is located on <br />the Bozorgzad property, it would not be part of this application. <br /> <br />It appears, however, that there remain unresolved issues including the location of the public <br />sidewalk with respect to the Bozorgzads' property - the Bozorgzads want the sidewalk moved <br />farther into the subject property; the location of the previously mentioned solid wall/fence in re- <br />lation to the Bozorgzads' existing driveway - the Bozorgzads want a minimum three-foot sepa- <br />ration between the relocated wall/fence and their driveway; relocating the existing eight-inch <br />water line - the water line must be relocated to accommodate the relocated wall/fence; and the <br />payment of funds between the applicants and the Bozorgzads. Regarding the sidewalk's loca- <br />tion, the Bozorgzads believe that Condition No. 8 of PUD-99-02 provides the ability to revisit <br />the sidewalk's location even though there is an existing easement for the sidewalk's location. <br /> <br />The location of the public sidewalk between Sycamore Terrace and San Carlos Way shown on <br />the proposed development plan is consistent with the North Sycamore Specific Plan, reflects the <br />alignment shown on the PUD-99~02, and is located in the existing easement created for that pur- <br />pose. As previously stated, staff would support Mr. Bozorgzad replacing his existing open fence <br />with a solid wall/fence. In staff's opinion, the solid wall/fence would effectively screen his <br />property from the view of pedestrians on the sidewalk. <br /> <br />Based upon responses to the City's public hearing notices, covering the entire San Carlos Way/ <br />San Juan Way/San Luis Court/Sonoma Drive neighborhoods, the majority of the comments re- <br />ceived by staff support the sidewalk. Gail and Joel Olney (5855 San Juan Way), Jeff and Kristi <br />May (5833 San Juan Way), Jill and Tony Battilega (5836 San Juan Way), Larry and Suzan <br />Dingman (387 Sycamore Road), Linda Walton (5862 San Juan Way), and Shareef Mahdavi <br />(5708 Hidden Creek Court) support the sidewalk. Hossein and Mojgan Bozorgzad (6056 Syca- <br />more Terrace) and Steven Liu and Jenny Wong (5816 San Carlos Way) oppose the sidewalk. <br />Tom and Mary Greene (386 Sycamore Road) did not comment on the sidewalk. Given the ex- <br />tent of the past record of public comment on the public sidewalk, staff did not consider it to be <br />necessary to hold a neighborhood meeting. <br /> <br />PSP-08 <br /> <br />Deleting the sidewalk connection from this project would require the City's approval of PSP-08, <br />an amendment to the North Sycamore Specific Plan. The amendment is provided so that should <br />the Planning Commission determine that the sidewalk is not necessary, that it could be deleted <br />without delaying the applicant. As previously stated, the applicants intend to construct the <br />sidewalk and have incorporated its design in the proposed development plan. <br /> <br />Staff, however, does not support the amendment. The primary function of the three sidewalk <br />connections is to provide pedestrian linkages t~om the neighborhoods on the north side of the <br />Specific Plan area to Sycamore Creek way and the public trail by Sycamore Creek.
