o One, Make sure and let the potential buyer know that we will be fighting
the path.
(~ Two, since number of times you have mentioned that you feel morally
obligated to repay us for your portion of the improvements. By at least
making the pedestrian path along my lot and your lot #4 acceptable to my
family, you should no longer feel any moral obligation toward us.
· 62. From then (mid 2003) we did not hear anything more fi:om you until we
heard fi:om another neighbor in September of 2004, that plans have been
submitted to City.
· 63. Upon, review of the plans in the City I immediately contacted you with the
same concerns about the pedestrian pathway.
· 64. After a few pleasant conversations on the phone you promised that I would be
contacted by your developer, which did not happen.
· 65. I sent you an e-mail expressing our disappointment on being left in the dark
in late September.
· 66. After, that we were contacted by Mr. Lamb, which started to escalate the
issue.
· 67. I sent you another e-mall on October 2004. Letting you know that Mr. Lamb
as your representative has decided to escalate the matter and forced me into
retaining an attorney.
· 68. I got a phone call fi:om you with a promise to call me back in two days.
· 69. Have not heard fi:om you directly since. I have only heard Mr. Lambs
understanding of what has happened between us in the past.

Feel flee to let us know if any of these facts are incorrect.

We attempted to be very accommodating and did not force you to pay for one-half of the
road improvements because you were not developing yourself. Now you are developing
years ahead of when you told us and the Planning Commission you would develop. It is
only fair that you make reasonable accommodations to protect our privacy. We have
explained to Mr. Lamb what it will take to make the pedestrian path acceptable to protect
our privacy:
a. Bow the path away fi:om our property line by about 3 feet along the fi:ont of
the two lots.
b. Do a land exchange to deed about 3 feet along the front of our property to us,
and we would deed about 3 feet along the back of our property to you.
c. Move the City water line over to the new center of the pedestrian path.
d. Install a solid wall along the new property line fi:om the end of our existing
wall forward.

Regards,

Page 5
