California 94566-7767 <br /> <br />Re: Road Payment Issue With Greenbrier/Sycamore <br />Dear Mr. Bach: <br /> <br />I spoke with Mr. Rieser of Sycamore early-this week. He advised that your portion of the roadway <br />was paid to your neighbor under the agreement between themselves. I also had a pleasant <br />conversation with your neighbor Hoss and he confirmed your discussion whereby he is assuming <br />all costs of the roadway. Although he would not discuss terms of his agreemem with Greenbrier, <br />he did confirm that the money he received from same was for the roadway and he perceived it as <br />his own. <br /> <br />In short, without actually looking at the Greenbrier and Hoss agreement, I cannot tell you <br />specifically whether Greenbrier has done anything wrong. Greenbrier acknowledges that the <br />money they held back on your deal was given to Hoss and he is to build the private road. It is my <br />suspicion that Greenbrier double dipped and promised Hoss the cost of a roadway and offered you <br />one half and simply is benefitting from the dual promise with a single paymem. I cannot tell you <br />that Greenbrier has done anything legally actionable, and suggest you wait and see how the road <br />construction goes.
