D. By separate instruments, the Bachs will dedicafe to the City thc remaining width of <br />right of way to make the E.V.A.E., P.S.E. and P.T.E. shown on Paxeel Map 7534 meet City <br />standards for the Bozorgzad subdivision and the anticipated future subdivision of the Bach parcel <br />into three or four parcels. <br /> <br /> E. By the terms of this Agreement, the Bachs and Bozorgzafls will grant each other cross <br />easements over the P.A.E. and provide for the orderly maintenance thereof. When used herein, the <br />term "private access easement" or "P.A.E." includes vehicular and pedestrian access and private <br />utility access of all kinds, including use of underground conduits. <br /> <br />NOW IltEREFORE, for good and valuable consideration acknowledged hereby, the parties hereto <br />agree as follows: <br /> <br />Grant of E.V.A.E., P,S.E. and P.T.E. to City <br />Bachs axe granting P.S.E., E.V.A.E. and P.T.E. shown on their lands by Parcel Map 7534 <br />to the City by separate instruments. <br /> <br />Grant of Cross Easements <br />a. Bozorgzads reserve for the benefit of Pamels 2, 3 and 4 of Parcel Map 7534 and grant <br />to the Bach parcel a Private Access Easement ("P.A.E.") over that portion of Parcel Map <br />7534 designated as "P.A.E." and more particularly described in Exhibit D. <br /> <br />b. Bachs reserve for the benefit of the Bach Parcel (including each lot created by a <br />future subdivision of the Bach Parcel) and grant to Parcels 2,3 and 4 of Parcel Map 7534 a <br />Private Access Easement ("P.A.E.') over that land described in Exhibit E. <br /> <br />c. The combination of the P.A.E.'s created by Subparagraphs (a) and (b) shall be <br />referred to as the "Roadway Easement". The complete Roadway Easement area is indicated <br />by crosshatching on Exhibit F <br /> <br />Related Matters <br />a. The Roadway Easement shall be improved in the manner shown on the Improvement <br />Plans for Parcel Map 7534 prepared by Alexander and Associates in the form finally <br />approved by the City ofPleasanton, ltachs ami Bozougzad~ ar~ ~ re~on~'i~ ft~ half of 4 <br />lh~ cost of inSlallation of flae roadv~y. By separate agreement, Bachs and BozorL'~'~ hav~ <br />~ made arrangement with Gr~afl~ar Hom~s for their re~poctive shares of flae cost ofv <br />roadway in~llafion. <br /> <br />b. Bachs and Bozorgzads plan to apply to the City for pem,ission to install a gated entry <br />to the Roadway Easement near Sycamore Creek Way. In the event said application is <br />approved by City, costs of installation and mainlenance shall be shared on the same basis <br />as provided for maintenance of the Roadway Easement. Determination of the acceptability <br />of the gate remains within the City's discretion. <br /> <br /> <br />
