11/10/2000 - Greenbriar refused to return our funds to us. Greenbriur says that the money was <br />spent to improve our property, but gave no explanation (s~e attachment D). <br /> <br />12/7f2000 - This day that will live in infamy. My attorney informed mc that my portion of the <br />roadway was paid to Mr. Bozorgzad. { am furtber told that Mr. Bozorgzad confirmed that he <br />is assuming all costs of the roadway. Mr. Bozorgzad would not discuss the terms of his <br />agreement with Grecnbriar (sec attachment E). I paid William F. Burns, Esq. $425.00 in an <br />attempt to recover the $27,300.00 plus interest (see attachment I). Mr. Bozorgzad was aware the <br />whole time that he had bean given our money long ago. <br /> <br />3/26/2001 - Despite many times he said he would pay ali expenses of the roadway, Mr. <br />Bozorgzad now asks us to help out with the cost of the joint trench and utility Services. We agree <br />to share in the expenses and upgrade the utilities so that the road would not have to be opened for <br />our future lots so we gave Mr. Bozorgzad a check (#6309) for $20,716.50 (see attachment J). <br /> <br />8/9/2001 - Even knowing that we are planning on moving out of California I agreed to spruce up <br />my barn area to improve the view from the BozorgTad's new house on the hill. Check #6371 for <br />$1,640.00 was to pay one of Mr. Bozorgzad's workers labor to replace the roof on our barn. Our <br />material costs were another $2,000.00. <br /> <br />1/2/2002 - After sending a letter of complaint to the city about outstanding disagreements with <br />Greenbriar, thc City of Pleasanton replied to our complaints. Issue 1 states that Mr. Bozorgzad <br />was reimbursed by the developer for our portion oftbe road. (see attachment K) <br /> <br />5/22/2002 - Even though we now live in Montana we agreed to let Mr. Bozorgzad to plant <br />screening trees on our property to improve the view from his house. Check # 6572 for $1,000.00 <br />for trees we'll never see. <br /> <br />When the Bozorgzads wanted to build their dream house I backed them in every way I could. I <br />rallied the surrounding neighbors as best as I could and we turned up in record numbers at city <br />planning and city council meeting to speak in support of their plans. I wished them health and <br />happiness in their new home. It is honestly beyond my imagination that they would not speak out <br />in strong support of my project at this time. It is especially disheartening to know that the <br />Bozorgzads, whom we considered to be friends (they were among the first of our friends to come <br />visit us in our new home in Montana and we have been writing friendly e-mails to one another for <br />several years - See Attachment L for one of our most recent e-mails), now are making false <br />claims against us. In hindsight, we feel that they must never have intended to honor their <br />agreement to allow the pathway to go through or our property to be developed. <br /> <br />I purchased my property in 1979. I wanted to live out my life right there on my little ranch. Due <br />to so many things beyond my control the area evolved into residential neighborhood. I am a <br />country boy. I am happy here in Montana. Greenbriar and so many others were accommodated <br />when my family allowed our home to be relocated and our lives disrupted.
