The proposed conditional use will comply with each ofthe applicable <br />provisions of this chapter. <br /> <br />The site's C-C zoning conditionally permits the establishment of massage <br />facilities. The proposed use complies with all relevant sections of the <br />zoning ordinance. Granting a conditional use permit to the applicants to <br />operate a therapeutic massage facility is consistent with the City's ability <br />to regulate zoning as listed in Municipal Code Section 18.124 <br />"Conditional Uses." <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that the proposed massage facility will be <br />situated to provide a safe and nuisance-free environment for patrons, users, and <br />adjacent property owners. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Secti on 1. <br /> <br />Approves Case UP-96-78, the application of Victoria Deguara, d.b.a. Victoria's <br />Salon, for a conditional use permit to operate a therapeutic massage facility <br />within an existing beauty parlor located at 200 Rose Avenue, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this case by <br />reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
