Resolution No. PC-96-82
Page 2

B. The proposed location ofthe conditional use and the conditions under
which it would be operated or maintained will not be detrimental to the
public health, safety, or welfare, or materially injurious to the properties or
improvements in the vicinity.

As proposed, the consignment store will not alter in any way the approved
exterior of the building so as to detract from its development standards. In
addition, the consignment store will not interfere with surrounding uses'
ability to operate. The proposed store would add to the economic vitality
and diversity ofthe shopping center, possibly contributing patronage to
other businesses. The consignment store would only allow merchandise
deliveries by a contract delivery service during business hours, which
would reduce possible adverse impacts on the adjacent tenants. A
condition would also require that the exterior ofthe store remain free of
drop-off items at all times. The store would not subject surrounding uses
to heavy truck traffic, hazardous conditions, or other objectionable
influences. As conditioned, the proposed use will be compatible with
adjacent retail and office uses located within the building.

C. The proposed conditional use will comply with each of the applicable
provisions of this chapter.

The site's PUD-C zoning conditionally permits the establishment of
consignment stores. In addition, the proposed use complies with all
relevant sections of the zoning ordinance. Granting a conditional use
permit to the applicant would be consistent with the City's ability to
regulate zoning as listed in the Municipal Code Chapter 18.124.

WHEREAS, projects of this nature are categorically exempt from the requirements of the
California Environmental Quality Act (CEQA); therefore, no environmental
document was prepared for this project.

WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will
be compatible with the surrounding uses and neighborhood.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON
RESOLVES THE FOLLOWING:

Section 1.

Approves Case UP-96-67, the application of Consignment Plus Home
Furnishings, for a conditional use permit to operate a consignment sales for home
furnishings (secondhard store) at 4250 Rosewood Drive, within an existing
building located at the Rose Pavilion Shopping Center, subject to the conditions
shown in Exhibit "B," attached hereto and made part of this case by reference.

Section 2.

This resolution shall become effective 15 days after its passage and adoption
unless appealed prior to that time.
