<br />Resolution No. PC-96-82 <br />Page 2 <br /> <br />B. The proposed location ofthe conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />As proposed, the consignment store will not alter in any way the approved <br />exterior of the building so as to detract from its development standards. In <br />addition, the consignment store will not interfere with surrounding uses' <br />ability to operate. The proposed store would add to the economic vitality <br />and diversity ofthe shopping center, possibly contributing patronage to <br />other businesses. The consignment store would only allow merchandise <br />deliveries by a contract delivery service during business hours, which <br />would reduce possible adverse impacts on the adjacent tenants. A <br />condition would also require that the exterior ofthe store remain free of <br />drop-off items at all times. The store would not subject surrounding uses <br />to heavy truck traffic, hazardous conditions, or other objectionable <br />influences. As conditioned, the proposed use will be compatible with <br />adjacent retail and office uses located within the building. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The site's PUD-C zoning conditionally permits the establishment of <br />consignment stores. In addition, the proposed use complies with all <br />relevant sections of the zoning ordinance. Granting a conditional use <br />permit to the applicant would be consistent with the City's ability to <br />regulate zoning as listed in the Municipal Code Chapter 18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with the surrounding uses and neighborhood. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-96-67, the application of Consignment Plus Home <br />Furnishings, for a conditional use permit to operate a consignment sales for home <br />furnishings (secondhard store) at 4250 Rosewood Drive, within an existing <br />building located at the Rose Pavilion Shopping Center, subject to the conditions <br />shown in Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
