ORDINANCE N0. 213 <br /> <br /> REGULATIN~ TAXICABS IN THE TOWN <br /> OF PLEAS~J~TON <br /> <br /> THE CITY COUD,~0II- OF T}iE T01';~ OF PLEASA~jTON DOES 0}~DAIN AS FOLLOWS: <br /> <br /> Section 1: DEFINITIONS. For the purpose of this <br /> Article certain ~,:ords and phrases are defined, and certain pro- <br /> visions shall be construed, as herein set out, unless it shall <br /> be apparent from their context that they have a different <br /> meaning. <br /> <br /> Section 1.1: TAXICAB DEFINED. A "Taxicab" is an <br /> automobile or other automotor propelled vehicle u~ed in the <br /> transportation of Passengers for hire over the public streets of <br /> the Town of Pleasanton and not over a defined route or upon a <br /> fixed schedule. <br /> <br /> Section 1.2: OWNER DEFINED. An "owner" is any person, <br />firm or cornoration having proprietary control of, or right to <br />nro~rietary control of, any taxicab as herein defined. <br /> <br /> Section 1.3: DRIVER DEFINED. A "driver" is any person <br /> in charge of or operating any taxicab, as herein defined, either <br /> as agent, employee or otherwise, under the direction of the <br /> owner, as herein defined. <br /> <br />Section 2: 0~NER~S PEI~IT TO OPERATE TAXICAB. It <br />shall be unlawful to operate any taxicab in the Town of Pleasanton <br />unless the owner thereof shall apply for, and obtain, a permit <br />so to do, which 'permit shall be applied for, granted and in <br />existence, all. in comOliance with the provisions of this <br />Ordinance. The application for such owner ~s permit shall set <br />forth the number of vehicles nrooosed to be operated, a complete <br />description of the vehicles oroposed to be operated, and of the <br />0roposed operations, together with the initial rates to be <br />charged therefor. <br /> In addition thereto, every anplication for an owner Is <br />permit to operate a taxicab shall set forth, in full, the color <br />scheme and characteristic insignia to be used to designate the <br />vehicles of said owner. Such aOplications for an owner Is permit <br />,~hall also be accompanied by a sworn financial statement of the <br />anDlies. or. The investigating official referred to in Section 2.1 <br />of this Ordinance, to whom the application shall be referred, <br />shall be the Chief of Police. <br /> <br /> Section 2.1: ACTION ON APPLICATION FOR 0I¢NER'S PE~{IT <br />TO OPERATE TAXICABS. The Chief of Police shall deny the same <br />if it shall appear to his satisfaction that such vehicle proposed <br />to be operated is inadenuate or unsafe; that the applicant has <br />been convicted of a felony or the violation of any narcotic law <br />or of any Penal law involving nots1 turpitude; ~hat the <br />a,oplicant's proposed color ,~cheme, name, monogram, in.~ignia, <br />uniform or cap will be in conflict with, or imitate, any color <br />scheme, name, monogram, insignia, uniform or cap used by any <br />other person operating a public taxicab, in SUCll a manner as to <br />be mi~leadin~ or tend to deceive or defraud the public. <br /> No permit shall be granted unless public convenience <br />and necessity shall be ,~hown to exist by the aOplicant.
